You Won Your Bid at a Foreclosure Auction. Now How Do You Get In?

You placed your bid, the auctioneer moved on, and you won. Now what?

Winning a Florida foreclosure auction is the start of a process, not the end of one. Between the moment the gavel falls and the moment you have legal control of the property, several steps must happen in the right order.

Immediately After the Auction

Once you are declared the winning bidder, you must promptly place your deposit as directed by the Clerk of Court. The balance is typically due by noon the next business day. Failing to meet this deadline can result in forfeiture of your deposit and re-listing of the property.

After payment is confirmed, the Clerk issues a Certificate of Sale. This document records that the auction occurred and that you were the winning bidder. It is not yet title.

The Ten-Day Waiting Period

After the Certificate of Sale is issued, Florida law requires a ten-day waiting period before the Certificate of Title can be issued. During this window, any party with legal standing can file an objection. If no valid objection is filed, the Certificate of Title is issued. The Certificate of Title is the document that officially makes you the property owner.

Assessing the Property

Once you have the Certificate of Title, visit the property to assess its condition and occupancy status. When you visit, you may find:

  • The property is vacant and you can access it
  • The previous owner or their family is still living there
  • Tenants are occupying the property
  • Unauthorized occupants are present

When the Property Is Occupied

If you arrive and find occupants, do not demand immediate entry. Gather basic information: who is living there, how many people, and what their relationship to the property is. This shapes the legal process you will need to follow.

Cash for Keys

Many experienced foreclosure investors offer occupants a cash incentive to vacate voluntarily by a specific date. This approach avoids the time and cost of a court proceeding. The agreement should be put in writing with a clear move-out date and a conditional payment structure.

Legal Possession Proceedings

When occupants refuse to leave voluntarily, the legal process depends on who they are. Foreclosure judgments in Florida typically include a provision for a writ of possession, which directs the sheriff to remove occupants and deliver possession to the new owner.

Tenants present an additional layer of complexity. Federal law may provide certain protections for bona fide tenants occupying a foreclosed property.

Common Mistakes After Winning a Foreclosure Auction

  • Attempting to enter the property before the Certificate of Title is issued
  • Changing locks or removing personal property without legal authority
  • Threatening occupants or engaging in self-help eviction tactics
  • Misidentifying a tenant as an unauthorized occupant and following the wrong legal process
  • Failing to document the property's condition before any work begins
